Abstract: In China, the ignoring of variety rights has severely restricted the agricultural technology innovation, and limited the agricultural exports. Now, the agricultural technology management system goes against the output of variety rights; the new plant variety system costs highly; agricultural technicians ignore the variety rights. The reasons were as follows, the farmers and agricultural scientists were lack of intellectual property awareness, the government arranged agricultural technology management, and it's difficult to protect the agricultural intellectual property rights for the characteristics of agricultural technology. So, we should innovate the agricultural technology management system, molulate the plant variety system, and severely punish those who violate the variety law．
